Hyperactive is very interested in doing whatever it takes to keep and maintain your trust in us as your Host. To this end, if you are considering canceling, we kindly ask that you call and discuss your issues with a member of management. We would like the opportunity to find out what we could have done better, as well as ask for a second chance to make it right and keep your Hosting and osCommerce business. Not every company can please every customer, every time, but give us the chance and we promise to try and correct the issues that are making you consider this cancellation. Hyperactive, Inc. (referred hereinafter as 'Hyperactive Inc.', 'HyperactiveHosting.com', 'our', 'we' and 'us') is a web hosting provider and development company. All prepaid accounts on our web servers are subject to the Refund Policy as described in this document. Under this Refund Policy, your placement of files, data, media content on our servers, leasing of dedicated equipment, use of colocation facilities, or purchase of bandwidth or any other good or service sold by Hyperactive is an acknowledgement that you have read, understand, and agree to be bound by the terms and conditions outlined below. - Refunding Policy We do give refunds for full pre-paid months unused, should you want to cancel your prepaid hosting service. If you decide to cancel after prepayment, you will not receive a refund for the current month in use (we do not give partial months refunds). If you have prepaid and received a multi-month discount, upon cancellation we will figure the refund retroactively withdrawing the discount back to the discount level that coincides with the start date of your account. This will result in paying the discounted price for the months used at the discount level at time of cancellation. This only applies to cancellation by the client. Hyperactive, Inc. reserves the right to not refund any accounts that have been terminated as a result of a violation of our Acceptable Use Policy or to refund specific products. Invoices are generated 7 days prior to your billing date. For this reason cancellations must be received 10 (10) days or more from your billing date. All cancellations received within 10 days of your billing date will be processed the following month, and the current due invoice charged to your preferred billing method.
- FREE DOMAIN REGISTRATIONS AND SSL CERTIFICATES
Hyperactive provides free SSL Certificates and Domain Registrations on some hosting packages.These domain registrations and SSL Certificates are only free if your hosting account remains active and paid in full for a term equal to 12 months from the date that we provide you the domain registration or SSL Certificate. If you cancel hosting before the 12 month period, you will be billed and are responsible for paying full retail price for the domain name registration or SSL certificate, and you release us to bill your credit card for that amount.In plain terms, the SSL Certificate or Domain Registration is "Free for as long as you host", and once you are no longer a hosting customer, you owe us for the Domain Registration or SSL Certificate in arrears.The SSL Certificates and Domain registrations we do, are transferable to your new host, and as such if your not going to host with us, we need to charge you for a product your going to use at another host, this is irregardless of whether you actually use it at the new host. All sales are final, and us providing you a certificate or domain name, which is free, billed later, or charged on the spot constitutes a "sale", even if we choose to bill you for it at cancellation and call it a "Free domain registration or SSL Certificate" in our advertising venues, website, and any digital or printed media. - Refunding and cancellation Procedure The customer must submit an "product Cancellation" request as follows:
1. Log in to https://portal.hyperactivehosting.com 2. Click "My Services" from the header menu. 3. Click the "edit Icon" to the right of the product you wish to cancel. 3. scroll to the bottom of the page and click "Request Cancellation".
**Do not cancel your account until you have safely moved your files and databases either to your own computer or another server. You further understand that on receipt of your cancellation ticket, Hyperactive Inc. has full rights to delete any and all files and databases currently held on our servers. You further release Hyperactive Inc. from any and all liability in the case we delete such files and or databases.**
We will not accept phone or email cancellations. There is no way for us to verify that it is indeed you that is canceling your service and not one of your competitors. The cancellation form will ask for your billing system password, as well as the package ID numbers you are wishing to cancel. You may cancel all, or only some of your packages if you like.
Once we have received the request, we will check on your account status. Depending on your remaining hosting period with us, we will compute the sum to be refunded to you, as outlined above. An email will be sent to the Primary Contact E-Mail address on the account to acknowledge the account cancellation and amount that will be refunded back to you. - Refund Payment Method All customers will be refunded via company check or given credit in our billing system to be used the following month in the case that you did not cancel all of your packages. Which method is used is at the sole discretion of Hyperactive Inc. All refunds will be processed within 7 business days after we have reviewed and confirmed the amount to be refunded.
- Exclusion Hyperactive Inc. reserves the right to refuse to refund any accounts that have been terminated as a result of a violation of our Acceptable Use Policy . Hyperactive Inc. also reserves the right to not issue refunds for payments made on specific products such as IP Addresses, SSL Certificates, Programming and Development Labor, etc.
- Modification of these terms and condition Hyperactive Inc. reserves the right to change the terms, conditions, and notices under which this policy is written, without prior notice. Furthermore, you agree that Hyperactive Inc. will not be responsible for making you aware of changes to this agreement. You agree that it is your sole responsibility to periodically check the contents of this agreement for changes as they may affect you.
